1) Acceptance of these Terms
These Terms of Service ("Terms") govern your access to and use of What Book Is This (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree, do not use the Service.
2) Eligibility and account responsibility
You represent that you have legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
You are responsible for:
- Maintaining account credential security
- All activity under your account
- Providing accurate and up-to-date account information
3) Service description
The Service helps users identify books based on descriptions, memory fragments, and related text inputs. Features, availability, and technical implementations may change over time.
We may add, modify, suspend, or discontinue parts of the Service at any time, including for maintenance, security, legal, or product reasons.
4) Acceptable use
You agree not to:
- Violate applicable laws or third-party rights
- Attempt unauthorized access, interference, or disruption
- Circumvent access controls, quotas, paywalls, or security mechanisms
- Reverse engineer or abuse non-public portions of the Service
- Use automated means to overload or degrade the Service
- Submit malicious code or harmful content
- Use the Service to infringe IP, privacy, or publicity rights
5) User content and rights
You may provide prompts, descriptions, or other content ("User Content") when using the Service.
- You retain ownership of your User Content.
- You grant us and our subprocessors a limited license to host, process, transmit, and use User Content as needed to operate, secure, and improve the Service, and to comply with legal obligations.
- You represent that you have rights to submit the User Content and that doing so does not violate law or third-party rights.
6) AI outputs and limitations
The Service may generate AI-assisted outputs. You acknowledge that:
- Outputs may be inaccurate, incomplete, or not uniquely correct
- Outputs are provided for informational purposes
- You are responsible for evaluating and using outputs appropriately
The Service is not legal, medical, financial, or other regulated professional advice.
7) Billing, subscriptions, and credits
If paid features are offered:
- Billing may be processed by third-party payment providers (for example, Stripe)
- Prices, plan terms, and renewal terms shown at checkout govern your purchase
- Subscription fees may recur unless canceled according to your plan terms
- Credits, where offered, are licensed (not sold), non-transferable, and may expire if disclosed at purchase
- Taxes may apply depending on jurisdiction
Unless required by law or explicitly stated at checkout, fees are non-refundable.
8) Third-party services
The Service may rely on third-party providers for hosting, authentication, payments, and AI processing. We are not responsible for outages or policy changes caused by those third parties, though we will make commercially reasonable efforts to maintain continuity.
9) Intellectual property
Except for User Content and third-party materials, the Service and its software, design, branding, and content are owned by us or our licensors and protected by applicable intellectual property laws.
No rights are granted except as expressly stated in these Terms.
10) Suspension and termination
We may suspend or terminate access immediately if we reasonably believe you violated these Terms, created security or legal risk, or engaged in abuse or fraud.
You may stop using the Service at any time. Termination does not affect rights and obligations that by nature survive termination (for example, payment obligations, disclaimers, limitations of liability, and dispute terms).
11) Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, or error-free operation.
12) Limitation of liability
To the maximum extent permitted by law, we and our affiliates, officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, goodwill, or business interruption.
Where liability cannot be fully excluded, our aggregate liability for claims related to the Service is limited to the greater of (a) amounts you paid to us for the Service in the 12 months before the claim, or (b) USD 100.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13) Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless us and our affiliates, officers, employees, and suppliers from claims, liabilities, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your User Content, or your violation of these Terms.
14) Governing law and disputes
These Terms are governed by the laws applicable to the service operator's principal place of business, unless mandatory local consumer law requires otherwise.
You agree to attempt good-faith resolution by contacting support@whatbookisthis.com before initiating formal proceedings.
15) Changes to these Terms
We may update these Terms from time to time. Material updates will be posted with a revised effective date. Your continued use of the Service after updates becomes effective constitutes acceptance of the updated Terms, to the extent permitted by law.
